Terms & Conditions and Right of Withdrawal
**Terms and Conditions (T&C) for the Etsy Shop**
**1. Scope**
These Terms and Conditions apply to all orders placed by customers via the Etsy shop.
**2. Contracting Parties**
The purchase contract is concluded between the buyer and Sabine Praß, Lichtensteinstraße 10, 72770 Reutlingen, Germany.
**3. Conclusion of Contract**
By placing an order via Etsy, the buyer makes a binding offer to purchase. The contract is concluded by acceptance of the order by the seller, which takes place through payment confirmation or shipment of the product.
**4. Products**
Only handmade products are offered, which may slightly vary in color, shape, and appearance. Therefore, deviations from product images are possible and do not constitute defects. Each product is unique.
**5. Prices and Payment**
All prices include statutory VAT plus shipping costs. Payment is made via the payment methods offered by Etsy.
**6. Delivery and Shipping**
Shipping times are non-binding and may vary. The seller assumes no liability for any delays. The seller chooses an appropriate shipping service provider at their discretion. The risk of shipping is borne by the buyer.
**7. Right of Withdrawal**
As these are personalized and handmade products, the buyer has no right of withdrawal or return pursuant to § 312g (2) no. 1 BGB (exception from the right of withdrawal for custom-made goods). Therefore, returns are excluded except in cases of proven defects.
**8. Warranty and Defects**
Statutory warranty rights apply. Defects must be reported in writing without delay. In justified cases, repair or replacement delivery will be provided. Further claims are excluded.
**9. Liability**
Liability for damages not related to the delivered item itself is excluded, except in cases of intent or gross negligence.
**10. Data Protection**
Personal data will only be used for contract processing and shipping and will not be shared with third parties.
**11. Final Provisions**
German law applies. The place of jurisdiction is Reutlingen, provided the buyer is a merchant.
